These terms apply to Maker Badge at madebybadge.netlify.app (the "Service"), run by [Your full name], [Street and number, or c/o address service], [Postcode and city], Germany, [contact email] ("we", "us"). By using the editor, publishing a badge or embedding a badge on a website, you agree to these terms. If you don't agree, don't use the Service.
1. What the Service is
Maker Badge lets you design a small "Made by" badge and a profile (text, photo, links, social profiles, embeds and a signup form), and show it on websites:
- Self-contained code: the badge's code is generated in your browser. It runs on your website and does not depend on us.
- Updatable badges: we store your badge on our servers and serve it to the websites that embed it, so you can change it later. The same applies to the profile shown on a page.
The Service is free. There are no accounts. We may change, limit or discontinue any part of the Service at any time.
2. Your edit key
An updatable badge can be changed or deleted by anyone who has its edit key (stored in your browser) or its private edit link. Keep them private. We can't recover a lost key, and we're not responsible for changes made by someone who has your key or link.
3. Your content
You are responsible for everything you put into a badge: text, images, links, embeds and code ("your content"), and for the websites you put the badge on.
You keep all rights to your content. So that we can run the Service, you allow us to store, copy, process and show your content for as long as your badge is published, worldwide and free of charge. This ends when you unpublish the badge, except for copies we must keep by law or that are in backups for a short time.
You confirm that you have the rights to your content (for example to photos and logos) and that it doesn't break the law or these terms.
4. What's not allowed
Don't use the Service for, or put into a badge, content that:
- is pornographic or sexually explicit, or links to such content;
- sexualizes minors in any way;
- promotes violence, terrorism, or hatred against people because of their origin, religion, gender, sexual orientation, disability or similar;
- harasses, threatens, bullies or doxxes anyone;
- is a scam, phishing, or tries to collect passwords or payment details under false pretenses;
- spreads malware, or links to sites that do;
- offers or promotes illegal goods or services (e.g. drugs, weapons, counterfeit goods, illegal gambling);
- pretends to be someone else, or suggests a connection with a person or company that doesn't exist;
- infringes someone else's copyright, trademark, privacy or other rights;
- is spam, or misleads visitors about where a link goes.
Also don't:
- try to break, overload, scan or get around the limits or security of the Service (including its API and badge loader);
- use the Service to send people email or messages they didn't ask for;
- use automated tools to create large numbers of badges, except through our documented API and MCP server within their limits.
5. Checks and removal
We check published content, automatically or by hand, for example by comparing links against lists of known phishing, malware and adult websites. We may refuse to publish a badge that seems to break these terms.
We may remove, disable or change the visibility of any badge, and block access to the Service, without notice if we believe it breaks these terms or the law, or to protect visitors, other users or the Service. Where the law requires it and it's possible, we'll tell you why. As there are no accounts, we may have no way to contact you.
6. Reporting content
To report a badge that you believe is illegal or breaks these terms, email [report email] with the badge's id or the page where you saw it, and why. We review reports promptly and act on them. If you disagree with a decision we made about a report or your badge, reply to us and we'll look at it again.
7. Signup forms, embeds and third parties
- Signup forms: emails that visitors enter into a badge's built-in form are sent directly from the visitor's browser to the address (webhook) you set. We don't receive or store them. You are responsible for handling this data lawfully, including getting any consent you need and telling visitors how you use it.
- Embeds and links: videos, calendars, forms and pages from other providers (e.g. YouTube, Calendly, Tally) are loaded from those providers and governed by their terms and privacy policies. We don't control them.
- Your website: if you add the badge to a website, you are responsible for that website, including its privacy notices and any consent the badge or its embeds may need there.
8. Stats
For updatable badges, we count page views (sampled), popup opens and link clicks, without cookies or visitor identifiers and without storing IP addresses, and show you the totals. See our Privacy Policy (madebybadge.netlify.app/privacy). You can turn this off by adding data-stats="off" to the snippet.
9. Availability and changes
We run the Service on a best-effort basis. It may be unavailable, slow or contain errors, and we don't promise that it will keep working or that published badges will be kept forever. Keep your own copy of your badge (Options → Export as file). If we plan to shut down updatable badges, we'll try to announce it on the website in advance.
10. Liability
The Service is provided free of charge and "as is".
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we've given a guarantee. For slight negligence, we are only liable for breaching an essential obligation (one that makes the proper use of the Service possible in the first place and that you can normally rely on), and only up to the typical, foreseeable damage. Otherwise, our liability is excluded.
You'll compensate us for claims that others make against us because of your content or because you broke these terms, including reasonable legal costs, unless you're not at fault.
11. Changes to these terms
We may update these terms. The new version applies from the date shown on this page. If a change matters, we'll point it out on the website. If you keep using the Service after that, the new terms apply; if you don't agree, stop using it and unpublish your badges.
12. Donations
Donations (e.g. "Buy me a coffee") are voluntary gifts. They don't buy any service, priority or rights, and are handled by the payment provider under its own terms.
13. Law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your country. For merchants, the place of jurisdiction is [city].
We're not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.
